Service Agreement

This Service Agreement (“Agreement”) outlines the terms under which PayOneFee.com (“Company,” “we,” “our,” or “us”) provides flat-fee real estate listing and related services to homeowners (“Client,” “you,” or “your”). By purchasing or engaging our services, you agree to the terms set forth in this Agreement.
1. Scope of Services
PayOneFee.com provides a flat-fee, full-service real estate listing package in the State of Arizona. Services may include:
- Consultation with a licensed Arizona real estate agent
- Listing on the Multiple Listing Service (MLS)
- Professional marketing guidance or materials
- Pricing or valuation assistance
- Showing instructions and scheduling coordination
- Offer review and negotiation support
- Transaction management up to closing
- Administrative tasks related to the listing
- Our preferred service partners will be used throughout the entire process
The exact services included may vary based on the package purchased or agreed upon in writing.
2. Client Responsibilities
The Client agrees to:
- Provide accurate and honest information about the property
- Complete any required forms or disclosures
- Maintain the property in a condition suitable for showings
- Follow applicable laws and regulations relating to property sales in Arizona
- Respond promptly when the agent requires information or documents
- Allow PayOneFee.com to use submitted property photos and information for marketing purposes
The Client is solely responsible for:
- Property condition
- Legal compliance with fair housing laws
- Honest disclosure of material facts
- Allowing access for showings and inspections
3. Flat-Fee Payment Terms
PayOneFee.com charges a flat fee (e.g., $2,995) for its listing services.
Payment terms:
- A Retainer Fee of $500 is paid upfront before any listing work begins and will be applied towards your fee at time of closing. The total is $2,995.
- The Retainer Fee of $500 is non-refundable.
- We reserve the right to adjust pricing at any time, but only before your payment is submitted.
Any buyer-agent commission is separate and is negotiated between you and your listing agent.
4. No Guarantee of Sale
You acknowledge and agree that:
- PayOneFee.com does not guarantee that your home will sell.
- Market conditions vary and are outside our control.
- Your home’s price, condition, location, and market demand influence results.
We provide professional real estate expertise, but outcomes are not guaranteed.
5. Term, Cancellation & Refunds
a. Term
This Agreement remains in effect from the date of payment until:
- The listing expires,
- The property closes, or
- The Agreement is terminated by either party according to these terms.
b. Cancellation by Client
You may cancel at any time; however:
- Fees are non-refundable once any work has begun, including consultation, MLS preparation, or administrative processing.
- Third-party costs (MLS fees, photography, etc.) already incurred are also non-refundable.
c. Cancellation by Company
We may cancel the Agreement for reasons including:
- Fraudulent or misleading property information
- Non-cooperation or repeated lack of communication
- Safety concerns
- Violation of Arizona real estate laws
- Abuse of staff or unreasonable demands
If we cancel before any work begins, we may issue a full or partial refund at our sole discretion.
6. MLS Rules & Compliance
By using our services, you agree to comply with MLS rules, which may include:
- Honest and accurate listing data
- Required disclosures
- Notification of material changes to the property
- Timely updates regarding offers, status, or closing
We may modify listing details to comply with MLS policies.
7. Use of Photos, Media & Listing Content
You grant PayOneFee.com permission to use:
- Photos
- Videos
- Property descriptions
- Marketing materials
for the purpose of promoting your property on the MLS, third-party real estate platforms, and company advertising.
We retain the right to showcase anonymized success stories for marketing purposes.
8. Limitation of Liability
To the fullest extent permitted by Arizona law, PayOneFee.com is not liable for:
- Market performance or lack of offers
- Accuracy of third-party data
- Actions of buyers, agents, inspectors, lenders, or title companies
- Loss of profits, delays, or missed opportunities
- Damages resulting from inaccurate information provided by the Client
- Any errors beyond our reasonable control
Your use of the service is at your own risk.
9. Indemnification
You agree to indemnify and hold harmless PayOneFee.com, its licensed agents, owners, and affiliates from any claims or damages arising from:
- Your breach of this Agreement
- Misrepresentation of property information
- Violations of Arizona real estate law
- Failure to disclose material facts
10. Governing Law
This Agreement is governed by and interpreted according to the laws of the State of Arizona, without regard to conflict-of-law principles.
11. Entire Agreement
This document, together with any written listing agreement signed between you and the licensed agent representing PayOneFee.com, constitutes the entire Agreement between the parties.
Oral statements or prior agreements do not supersede this Agreement.
